Draft — requires legal review before publication
This document is a working draft prepared by the Thumbora team. It has not yet been reviewed by a lawyer and may change. Company details marked “[to be filled]” will be added before launch.
These Terms of Use (the “Terms”) govern your use of Thumbora, an online service for creating YouTube thumbnails with artificial intelligence, available at 4thumb.com (the “Service”). The Service is operated by [to be filled] (the “Company”, “we”, “us”).
By creating an account or using the Service you accept these Terms. If you don’t agree, don’t use the Service. Paid services are additionally governed by the Public Offer, the Payment Policy and the Refund Policy; personal data is processed as described in the Privacy Policy.

1.Who can use Thumbora
You must be at least 16 years old, or the minimum age required in your country to use online services without parental consent. To make payments you must be of legal age or act with the consent of a parent or guardian.
If you use the Service on behalf of a company, you confirm that you are authorized to accept these Terms on its behalf.
2.Your account
- You register with an email address and a password or with a Google account. Keep your credentials confidential — you are responsible for activity in your account.
- Provide accurate information and keep your email address up to date; we use it for account and payment notifications.
- You may not create multiple accounts to receive additional free credits.
- You can delete your account at any time in the settings. What happens on deletion is described in the Privacy Policy.
3.The Service
Thumbora lets you generate 16:9 images from text, photos and reference images, edit them with text instructions and in a built-in editor, keep versions in projects and export files. Images are generated by third-party AI models — currently Google’s Nano Banana models, accessed through the provider reAPI.
We continuously improve the Service and may change, add or remove features, models and limits. We will inform you in advance of changes that materially reduce what you have already paid for.
4.Credits
- Generations are paid for with credits — an internal unit of the Service. The number of credits per image depends on the model, resolution and mode and is shown before each generation.
- When a generation starts, the estimated credits are reserved. Credits are charged only for images that are successfully delivered. For images that fail, time out, are blocked by the provider’s safety filter or are cancelled before processing, the reserved credits are returned automatically.
- Credits are not money, have no cash value and cannot be exchanged for money (except for refunds under the Refund Policy), transferred or sold.
- New accounts may receive free sign-up credits (currently 30). Their amount and validity may change and may be limited in time.
- Subscription credits are valid until the end of the billing month for which they were granted. Expired credits are not restored.
- If credits were added by mistake, because of a technical error, fraud or a reversed payment, we may correct the balance.
5.Plans and subscriptions
- Paid plans are offered monthly or yearly. Current prices, credits and limits are listed on the pricing page.
- A subscription renews automatically at the end of each period and is charged to the payment method you used, until you cancel it.
- You can cancel at any time in Billing. After cancellation the plan stays active until the end of the paid period and is not renewed.
- If a renewal payment fails, the subscription enters a grace period of 3 days. If the payment does not succeed, the subscription ends and your account moves to the Free plan.
- The limits of your plan apply — resolution, images per generation, parallel generations, storage and available models.
6.Acceptable use
You may not use the Service to create, upload or distribute content that:
- impersonates a real person or organization, or misleads viewers about who is speaking or endorsing something;
- uses another person’s face or likeness without their explicit consent;
- is sexual or sexually explicit, or sexualizes minors in any way;
- promotes violence, terrorism, hatred, discrimination, harassment or self-harm;
- infringes copyright, trademarks or other rights — for example, other creators’ thumbnails copied as they are, or logos and characters you have no right to use;
- is deceptive in a way that can cause harm, including fake news, fraud or political deepfakes;
- violates the law or YouTube’s policies.
You also may not try to bypass limits or payments, access other users’ data, overload or reverse-engineer the Service, use automated scripts without our permission, or resell access to the Service. The AI provider applies its own safety filters; requests blocked by them are not charged.
7.Your content and AI output
- You keep all rights to the content you upload (photos, references, logos, texts). You confirm that you have the necessary rights and consents, including the consent of every person whose face you upload.
- You grant us a non-exclusive, worldwide, royalty-free license to store, process and transmit your content to our subcontractors solely to provide the Service to you. The license ends when you delete the content, except for copies we must keep by law or in backups for a limited time.
- As between you and us, the images you generate belong to you to the extent permitted by law, and you may use them for personal and commercial purposes, including your clients’ channels.
- AI output is generated automatically. Similar results may be produced for other users, and we don’t guarantee uniqueness. In some countries AI-generated images receive limited or no copyright protection.
- You are responsible for checking results before publishing — spelling, likeness, rights in elements of the image — and for how you use them.
8.Our intellectual property
The Service, its software, design, brand, texts and demo materials — including the demo thumbnail compositions on our website — belong to the Company or its licensors. These Terms do not transfer any rights to them except the right to use the Service as intended.
9.Availability
We aim to keep the Service available around the clock but don’t guarantee uninterrupted operation. Maintenance, failures of our providers (AI, storage, payments) or circumstances beyond our control may cause interruptions. If a generation fails because of such a problem, its credits are returned as described in the “Credits” section.
10.Suspension and termination
We may suspend or block an account that violates these Terms or the law, creates security risks or is used fraudulently. Where possible, we will notify you and explain why. You may stop using the Service and delete your account at any time.
11.Disclaimers and liability
- The Service is provided “as is”. We don’t guarantee that results will meet your expectations or bring a particular number of views or clicks.
- To the extent permitted by law, our total liability to you is limited to the amount you paid us in the 3 months before the claim. We are not liable for lost profits, for data you did not keep copies of, or for indirect damages.
- Nothing in these Terms limits liability that cannot be limited under applicable law, including consumer protection law.
12.Changes to these Terms
We may update these Terms. We will publish the new version on this page and, for material changes, notify you by email or in the Service at least 14 days before they take effect. If you keep using the Service after that, you accept the updated Terms.
13.Governing law and disputes
These Terms are governed by the law of Ukraine. We will try to resolve any dispute through negotiation — write to support@4thumb.com. If that fails, the dispute is resolved by a competent court of Ukraine, unless mandatory consumer protection law of your country provides otherwise.
